Terms of Business
These Terms of Business contain all the Terms of agreement between Bluepoppy Vehicle Solutions Ltd (“We”, “Us”, “Our”, “Ourselves”) and the Business/Consumer (“You”, “Your”, “Yourself”).
Our service to You shall be the sourcing of a vehicle and of financial products and services which match Your requirements. We recommend You must read these Terms of Business carefully that apply to Our appointment by You and the services We will provide.
We are a licensed credit broker and not a lender. We select our products from a range of finance providers having carried out a ‘fair analysis’ of the market in order to identify a suitable product.
Provision of Service
By signing Our order form, You are deemed to be accepting these Terms of Business and thereby have entered into a legally binding contract between Us and You for the provision of Our service. Your indication that You wish to proceed with the Quotation shall not in itself create a contract between Us and You.
Bluepoppy Vehicle Solutions accepts no responsibility for any errors or omissions regarding vehicle model or specification, including any optional extras, if You have accepted the order and these Terms of Business. It is Your responsibility to check the vehicle You are ordering is to Your requirements.
Until You enter into a financial agreement with a finance provider, there is no contract to hire a vehicle until the finance agreement is signed by You and the financial agreement has become operational.
Please note Our Terms of Business are separate to and are not connected to any lease or financial agreement You may enter into.
We use a number of industry leading finance providers to provide Our pricing. The prices advertised are an amalgamation of the best prices, at a point in time, from those finance providers, for the vehicles specified on the terms shown. Each price advertised is unique to an individual finance provider and therefore may only be available through that finance provider.
Should You, the customer not meet the financial or operational criteria of the particular finance provider, then We, Bluepoppy Vehicle Solutions, may have to offer, to meet Your requirements, an alternative finance provider, whose price may vary from the one advertised.
Prices quoted for Business leasing exclude VAT, and prices quoted for Personal leasing include VAT unless otherwise stated.
The VAT is set to the prevailing national rate at the time, should this rate change during the length of Your contract the payments will be adjusted accordingly.
We will provide a quotation for You based on Your specification needs and will not be held liable for any extras, options or otherwise You fail to adequately describe to Us.
We reserve the right to withdraw a quotation before or after a vehicle is ordered by You. This may be because of, but shall not be limited to, changes in money costs, manufacturers prices or residual values. We shall notify You of the change and You have the right to withdraw Your order if the change is not acceptable.
Following an acceptance by You of a quotation by Us, You will be required to complete a financial application form. We will carry out a credit check on You as part of Your application process.
When You apply for finance from a finance provider You must provide Us with certain personal information which We will share with the finance provider, Credit Reference (CRAs) and Fraud Prevention Agencies (FRAs) as this is necessary to help the finance provider decide whether to offer You finance. If You do not provide it to Us, We may not be able to offer finance. Your information will be used by the Finance Provider and these agencies as follows:
- The Finance Provider will check records about You and others held by Credit Reference and Fraud Prevention agencies, for e.g. to assess Your application for credit and verify identities to prevent and detect crime and money laundering. The Credit Reference Agencies will place a search footprint on Your credit file that may be seen by other lenders. They will supply public information (e.g. information held on the electoral register) as well as shared credit and fraud prevention information. The Fraud Prevention Agencies will use Your personal information to prevent fraud and money-laundering and to verify Your identity.
- If You advise Us of a director, a spouse or a financial associate, We will link Your records together. You must ensure that You have their agreement to disclose their information. Credit Reference Agencies also link Your records together. The links will remain on Your and their files until such a time as You or they successfully file for a disassociation with the Credit Reference Agencies to break the link.
- If You give Us false or inaccurate information or We suspect or identify fraud, We will record this and may also pass on the information to fraud Prevention Agencies and other organisations involved in crime prevention. Law enforcement agencies may also access and use this information. If fraud is detected, You could be refused certain services, finance or employment.
- We and other organisations may access and use from other countries the information recorded by Fraud Prevention Agencies, which may be publicly available sources. Your data may also be Used for other purposes for which You give Your permission or, in limited circumstances, when required by law or where permitted by relevant data protection and privacy law.
Under EU Regulation 2016/679 General Data Protection Regulation (“GDPR”) individuals have eight data protection rights which are:
- The right to be informed
- The right of access
- The right to rectification
- The right to erasure
- The right to restrict processing
- The right to data portability
- The right to object
Rights in relation to automated decision making and profiling.
Delivery and Documentation
All documentation required by the finance provider must be completed by You and returned to Us prior to the delivery of Your vehicle being arranged. If documentation is incorrectly completed and/or all supporting documents required by the finance provider have not been viewed by Ourselves delivery will also not be arranged.
Any outstanding monies owed to Us must be paid and cleared by You before delivery will be arranged.
Delivery timescales are an indication only and based upon information provided to Us. Whilst We endeavour to meet any timescale quoted, for the avoidance of doubt, We are unable to accept responsibility for any manufacturer delays which are beyond Our control.
We will not be liable for any compensation arising out of a delay to Your vehicle due to factors beyond Our control.
The statutory cooling off period observed by finance providers applies to all vehicles and as such, vehicles will not be delivered until the cooling off period has expired.
All vehicles must be insured Fully Comprehensive by You. We may require proof of insurance subject to finance provider rules. You must be a named driver or main policy holder on the insurance certificate.
A Document Fee is payable Once Your order has been received and the vehicle secured with the supplying dealer. This is a broker fee charged by Us and is payable in respect of the costs associated with the administration and service We deliver in processing Your vehicle order, arranging the finance and provision of a high level of Customer Service for the full duration of your lease. The amount required will be stated on Your quotation and Your order form prior to acceptance by You.
Payment of Our fee can be made by bank transfer to Our bank account or by Debit/Credit card by calling Us on 01275 371 467.
Bluepoppy Vehicle Solutions may at it’s absolute discretion require a deposit from You the customer prior to ordering the vehicle ordered by You the customer, from the supplying Dealer. The amount of deposit required will vary depending on the specification and delivery lead time of the vehicle. Deposits are held in a separate Client Bank Account and are refundable after delivery of the vehicle.
Excess Mileage Charges
We will provide details of the excess mileage charged and/or bandings on Your quotation and then subsequently on Your order form. Certain finance agreements have an excess mileage charge which is expressed as PPM (Pence Per Mile) and is charged when Your vehicle exceeds the agreed mileage over the total contract term. We recommend you refer to your finance agreement for full details on any excess mileage charges and how this cost may affect You.
Bluepoppy Vehicle Solutions Ltd will use a panel of carefully selected finance providers from which We may receive a commission.
The Financial Conduct Authority (FCA), www.fca.org.uk, expects any intermediary to disclose to the customer that a commission may be payable by the owner or creditor to the intermediary, and, if the customer asks, the amount of that commission. The Financial Conduct Authority has made it clear that ‘commission’ means any financial consideration.
In line with new legislation, if You would like Bluepoppy Vehicle Solutions Ltd to disclose any potential commission please make Your request in writing to Your Bluepoppy Vehicle Solutions Ltd contact or write to the Office Manager at Our address.
You have the legal right to cancel any contract between You and Us within 14 calendar days without giving any reason. This legal right applies equally to regulated personal customers, sole traders and partnerships.
Contracts for Limited Companies, Limited Liability Partnerships (LLP) and Partnerships with more than four partners are unregulated, so therefore, these rights do not apply.
Regulated – The cancellation period will expire 14 calendar days from the date Your signed order form has been received by Us and the vehicle secured with our supplying dealer. To exercise the right to cancel, You must inform Us of Your decision to cancel by a clear statement in writing by post or via email.
– If You cancel a contract between You and Us, within this period, We will reimburse, in full, to You any payments received from You. A reimbursement will be made without undue delay, and not later than 14 calendar days after the day on which We are informed about Your decision to cancel.
– If you cancel, a contract, for any reason, between You and Us, once this period has expired, You will incur a cancellation fee of £250 + VAT. Any amounts already paid by You to Us will be deducted from this cancellation fee and the difference payable within 7 calendar days from receipt of Our invoice to You
Unregulated – To exercise the right to cancel, You must inform Us of Your decision to cancel by a clear statement in writing by post or via email. You will incur a cancellation fee of £250 + VAT. Any amounts already paid by You to Us will be deducted from this cancellation fee and the difference payable within 7 calendar days from receipt of Our invoice to You.
Any additional costs incurred by Us due to a cancellation by You will be passed on to You. We will provide evidence of such costs upon request.
Statutory Rights/Third Party Rights
Nothing in these conditions shall affect Your statutory rights. We are committed to a high level of customer service. If You are dissatisfied with Our service to You, We will endeavour to resolve any issues in a fair and effective manner.
Nothing in these Terms gives any right to any third party to enforce any provision under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
If any provision of these Terms is found to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question will not be affected.
Terms shall be governed by the laws of England and Wales and the parties agree herewith that any dispute arising out of it shall be subject to the exclusive jurisdiction of the relevant court. These terms supersede all proposals, prior discussions and representations (whether oral or written) between Us relating to Our commencement of service provision.
Treating Customers Fairly
Treating customers fairly is a core principle at Bluepoppy Vehicle Solutions Ltd. This forms a cornerstone of how We do Business with all Our customers and is embedded in Our company culture. Bluepoppy Vehicle Solutions Ltd aim to provide the highest standard of service to all of Our customers. If, however, there is an occasion where You are disappointed with the service provided by Us, We would like to know. A full copy of Our formal written complaints procedure is available on request.

In the event We are unable to resolve any complaint to Your complete satisfaction You will be able to refer the matter for free independent conciliation via the British Vehicle Rental and Leasing Association (BVRLA).
Our performance under this agreement will be excused if We are unable to perform due to any cause beyond Our reasonable control (including but not limited to any labour dispute, act of God, war, act of terrorism, riot, civil unrest, fire, flood, storm, or any computer or internet related failure, error or delay).
Bluepoppy Vehicle Solutions Ltd reserve the right to make changes to these Terms of Business to comply with changes in the law or for regulatory reasons or We need to correct any error or omissions including any of the documentation.
Telephone calls may be recorded for training and monitoring purposes.
